This paper contributes to the scientific discussion on the provision of ecosystem services by water resources, with a particular focus on freshwater ecosystems. The research draws attention to the severe degradation affecting rivers around the world, identifying multiple interconnected causes, including intensive human activity. The study reveals a complex and risky situation, as outlined in major international reports and by European institutions themselves. It specifically focuses on the content of the recent 2024 Nature Restoration Law. The questions posed in the study address the legal instruments in place and the exercise of public power in water policy. Considerable space is devoted to examining the River Contracts instrument, from the emergence of its legal profiles to its territorial practices. River Contracts represent a highly applicable model that requires joint, synergistic commitment from public institutions, local communities, and individual citizens. The application of a subsidiary approach is considered, which finds its natural expression in the model of shared administration.
Il presente lavoro si inserisce nella riflessione scientifica relativa alla generazione di servizi ecosistemici assicurati dalle risorse idriche, in particolare dagli ecosistemi di acqua dolce. La ricerca evidenzia lo stato di forte degrado che interessa i fiumi di tutto il mondo, evidenziando cause multiple ed interconnesse, tra le quali l’intensiva attività antropica. Il panorama che si staglia nello studio interiorizza un deciso grado di complessità e un panorama del rischio avvertiti nei principali report internazionali e dalle stesse istituzioni europee, con un focus specifico sul contenuto del recente Regolamento Nature Restoration Law del 2024. Gli interrogativi posti nel lavoro si spostano sul piano degli strumenti giuridici preposti e sull’esercizio del potere pubblico in materia di politica idrica. Ampio spazio viene offerto alla disamina dello strumento dei Contratti di Fiume (CdF), tra l’emersione dei suoi profili giuridici e le prassi territoriali. I CdF rappresentano un modello ad alto potenziale applicativo, che richiede un impegno congiunto e sinergico delle istituzioni pubbliche, delle comunità locali e dei singoli cittadini. Viene valutata l’applicazione di un approccio sussidiario, che trova la sua naturale espressione nel modello dell’amministrazione condivisa.
