Finally, it underscores the risk that an overly restrictive regulatory approach may hinder the development of generative AI in Europe.

L’articolo esamina il funzionamento del Text and Data Mining (TDM) e il suo ruolo nell’addestramento dei sistemi di Intelligenza Artificiale generativa, evidenziandone le fasi tecniche e il valore economico. Analizza il quadro normativo europeo, in particolare le eccezioni previste dalla Direttiva Copyright, con attenzione al meccanismo di opt-out dei titolari dei diritti. Approfondisce le incertezze giuridiche legate alla qualificazione dell’addestramento come attività diTDMe ai possibili profili di violazione del diritto d’autore. Vengono inoltre richiamati i primi orientamenti giurisprudenziali e il ruolo dell’AI Act nel rafforzare obblighi di trasparenza e conformità.
