This paper analyses the arguments and conclusions reached in the ruling of the Civil Court of Cassation, sect. I, ord., 21 July 2025, no. 20415, which affirmed the validity and effectiveness of the agreement, entered into by the spouses during their marriage, whereby it was agreed that, in the event of their subsequent separation, the husband would be obliged to return a large sum of money to his wife and the latter would have to renounce certain movable assets in favor of the former, with the separation qualifying as an event inferred as the subject of a condition precedent contained in the agreement.
Il presente contributo si occupa di analizzare le argomentazioni e le conclusioni alle quali perviene la pronuncia della Cass. civ., sez. I, ord., 21 luglio 2025, n. 20415, con la quale si è affermata la validità e l’efficacia dell’accordo, stipulato dai coniugi nel corso della vita matrimoniale, con cui si è convenuto che, nel caso di successiva loro separazione personale, il marito sia obbligato a restituire alla moglie un’ingente somma di denaro e, quest’ultima, debba rinunciare ad alcuni beni mobili in favore del primo, qualificandosi, la separazione, quale evento dedotto ad oggetto di una condizione sospensiva contenuta nella convenzione.
