Eredità digitale e tutela dell’identità (digitale) dei defunti

Nonostante il sostantivo ‘eredità’ evochi una vicenda segnata dalla centralità dei tratti patrimoniali, la qualificazione dell’aggettivo ‘digitale’ sposta inevitabilmente il baricentro del fenomeno successorio, conferendo preminenza ai delicati profili post mortem. I riflessi apatrimoniali fermano, così, l’attenzione dell’interprete sulle esigenze di tutela dell’identità del de cuius, occasionate dalla sua morte, e che a questa sopravvivono, pretendendo un’osservanza statica, protratta in un tempo indefinito.
