Tu chiamali, se vuoi, sistemi di riconoscimento delle emozioni: considerazioni sulla disciplina posta in materia dal regolamento (UE) 2024/1689

This article examines the regulatory framework applicable to emotion recognition systems under the AI Act, analysing how their legal treatment evolved from the European Commission’s initial proposal to the final text adopted by the EU legislature. After providing an overview of the concept of emotion recognition and its main applications—drawing also on EU-funded research projects—the article focuses on the classification of these systems within the AI Act’s risk-based approach. Particular attention is devoted to two critical areas: data protection and the prohibition of certain practices.
