Accettazione beneficiata dell'eredità, opposizione a decreto ingiuntivo e opposizione all'esecuzione

Anyone who has made a declaration of acceptance of the inheritance with benefit, but has not yet closed the inventory, is in the position of being called or in any case in a situation of uncertainty as to the liability regime. If he exercised opposition to an injunction, as a judgment of merit concerning a credit of the deceased, he would incur a tacit acceptance of the inheritance pure and simple. The enforceability of the non-opposed injunction is that of a conviction which has become res judicata, but the res judicata does not extend to subsequent events; therefore, only in the context of opposition to the execution, it is possible for the heir with benefit to claim, as facts occurred to the injunction and the terms for opposing it, the definitive closure of the inventory and the liquidation of the inheritance by the curator pursuant to art. 508 of the Italian Civil Code.

Chi abbia reso dichiarazione di accettazione dell’eredità con beneficio, ma non abbia ancora chiuso l’inventario, si trova nella posizione di chiamato o comunque in una situazione di incertezza quanto al regime di responsabilità. Se costui esercitasse l’opposizione a decreto ingiuntivo, quale giudizio di merito riguardante un credito del defunto, incorrerebbe in una tacita accettazione pura e semplice dell’eredità. L’esecutività del decreto ingiuntivo non opposto è quella di una sentenza di condanna passata in giudicato, ma il giudicato non si estende ai fatti ad esso successivi; pertanto, soltanto in sede di opposizione all’esecuzione, è possibile, per l’erede beneficiato, far valere, come fatti sopravvenuti al decreto ingiuntivo e ai termini per opporlo, la chiusura definitiva dell’inventario e la liquidazione dell’eredità da parte del curatore ex art. 508 c.c.
