L’individuo nell’”ingranaggio processuale”. I rischi della giustizia penale connessi agli obblighi di parola e verità

From a guarantor's perspective, theoretical reflections on criminal proceedings and their dynamics traditionally focus on the accused (whether suspect, defendant, or convicted) to examine the mechanisms designed for their protection, the distortions suffered by the Code of Criminal Procedure in practice, and the more or less reasonable reforms to the latter. Upon closer inspection, however, there are also other figures who, in their interaction with the machinery of justice, find themselves exposed to non-negligible criminal risks. Although these risks are "secondary" and significantly reduced compared to those faced by the accused, they are nonetheless worthy of attention. Chief among these is the figure of the informed person (to use a generic expression that also includes witnesses). This work aims to uncover some of the risks faced by the declarant due to the obligations of speech and truth imposed on them. It also considers the fact that the risks borne by the informed person can translate into risks for the criminal justice system itself. This is particularly true in cases where the freedom of self-determination of the declarative source is not adequately protected.

In un’ottica garantista, le riflessioni teoriche sul processo penale e sulle sue dinamiche tradizionalmente pongono al centro la figura dell’accusato (indagato, imputato o condannato che sia) per concentrarsi sui meccanismi funzionali alla sua tutela, sulle distorsioni subite dal Codice di Rito nella prassi e sulle riforme più o meno ragionevoli di quest’ultimo. A ben guardare, vi sono tuttavia anche ulteriori figure che, nel contatto con la macchina della Giustizia, si trovano esposte a rischi penali non indifferenti, che seppur di “secondo livello” e decisamente ridotti rispetto a quelli corsi dall’accusato, non sono trascurabili. Prima tra tutte, vi è la figura della persona informata (per usare un’espressione generica che include anche il testimone). Il presente lavoro si propone appunto di snidare alcuni dei rischi a cui è esposto il dichiarante per vai degli obblighi di parole e verità che gravano sullo stesso, tenendo conto del fatto che il rischio a carico della persona informata può tradursi in un rischio per la stessa Giustizia penale; questo è vero soprattutto nei casi in cui a non essere adeguatamente tutelata è la libertà di autodeterminazione della fonte dichiarativa .
