The essay aims to investigate the influence exerted by jurisprudential thought on late antique imperial legislation, with particular regard to Justinian’s one, in order to ascertain how profoundly the techniques and logic developed by Roman jurists affected it. Within Justinian’s normative production, I have chosen to analyse a constitution, namely C. 4.27.2, that is particularly indicative of the role played by works and methods of the jurists, because it provides ample evidence of the development of the relationship between the classical legal science and the imperial legislation
