With judgment no. 10/2020, the Constitutional Court declared the request for the abrogative referendum concerning the abolition of the proportional method for allocating seats of the Chamber and the Senate inadmissible. In the referendum question the promoters had also included the partial repeal of law no. 51/2019 (delegating the Government to redefine the constituencies for the implementation of the constitutional reform in itinere concerning the reduction of the number of members of Parliament), in order to ensure the self-application of the rules deriving from a possible favorable outcome of the referendum. The reasons for the inadmissibility of the referendum are to be found in the double manipulation operated by the promoters: on the electoral law and on the delegation law for the redefinition of the constituencies, altering, in the latter case, the ratio of the same legislation, transformed from an act to implement the constitutional reform on the reduction of the number of members of Parliament to a law aimed at serving the 'proposal' to introduce a new election system for the Chambers. The intervention on Law no. 51/2019 was considered abnormal by the Court as it would have distorted its substance to create an unprecedented system of legislation, bypassing the legislative discretion. In essence, the referendum question determined an evident disproportion between what can legitimately be left to the popular decision and the impact that the same decision could have had on the legal system, not in terms of 'creation' of a new electoral system (as already happened with the referendum held on 1993), but with regard to relations between Parliament and abrogative referendum, intended as a power of negative legislation of the people. The electoral body vote would have turned into a concurrent form of "direct popular legislation", contradicting the representative nature of the constitutional system. The judgment no. 10/2020 seems to refer to the inadmissibility of this 'inverted' dynamics, taking strength from the words of the historic judgment no. 16/1978, highlighting how the abrogative referendum cannot become a "distorted instrument of representative democracy".

Con la sentenza n. 10 del 2020, la Corte costituzionale ha dichiarato inammissibile la richiesta di referendum abrogativo riguardante l’abolizione del metodo proporzionale nell’attribuzione dei seggi di Camera e Senato. Nel quesito referendario i promotori avevano inserito anche la parziale abrogazione della legge n. 51/2019 (di delega al Governo per la ridefinizione dei collegi elettorali in attuazione della riforma costituzionale in itinere sulla riduzione del numero dei parlamentari), con lo scopo di assicurare l’autoapplicatività della normativa di risulta conseguente ad un eventuale esito favorevole del referendum. Le ragioni della ‘bocciatura’ della domanda referendaria sono da ricercare nella doppia manipolazione operata dai promotori: sulla legge elettorale e sulla delega per la rideterminazione dei collegi elettorali, alterando, però, in quest’ultimo caso, la ragion d’essere della legislazione investita, con la sua trasformazione da atto di completamento della riforma costituzionale per la riduzione del numero dei parlamentari, a legge diretta a servire la ‘proposta’ di introdurre un nuovo sistema di elezione per le Camere. La ‘manovra’ compiuta sulla l. n. 51/2019 è stata giudicata dalla Consulta un intervento abnorme che ne avrebbe stravolto la sostanza per creare un inedito ‘percorso’ di produzione normativa, scavalcando la discrezionalità riservata al legislatore dal sistema costituzionale. In sostanza, il quesito presentato andava a determinare un’evidente sproporzione fra ciò che può essere legittimamente rimesso alla decisione popolare e l’impatto che la stessa avrebbe potuto avere sull’ordinamento. Questo non tanto in termini di ‘creazione’ di un nuovo sistema elettorale (come, peraltro, già accadde con il referendum del 1993), ma sul piano dei rapporti fra Parlamento e abrogazione referendaria intesa come potere di legislazione negativa del popolo. Il voto del corpo elettorale si sarebbe trasformato, infatti, in una concorrente forma di “legislazione popolare diretta”, in conflitto con l’impronta rappresentativa del nostro sistema costituzionale. È all’inammissibilità di questa dinamica ‘invertita’ che sembra riferirsi la sentenza n. 10/2020, prendendo forza dalle parole con cui la Corte, già nella storica sentenza n. 16/1978, ha evidenziato come il referendum abrogativo non possa diventare un “distorto strumento di democrazia rappresentativa”.
