This paper examines the role of different interpretations of GI legislation in promoting socially equitable Geographical Indication (GI) schemes. The first part of the paper is theoretical and includes an analysis of the US and EU legal frameworks for GIs. The second part presents two case studies. The first is about a cheese, Queso Chontaleño, from Nicaragua, where legislation on GI products is largely based on the US approach. The second is about a ham from Italy, Prosciutto di Parma, and reflects the European approach to GI legislation. Case studies show that GI legislation based on the institutionalisation of terroir is one of the conditions for socially equitable schemes, along with a territorial governance able to promote local development.
